As a leading measure of journal quality, acceptance rates of journals can influence faculty recruitment, salary, tenure and promotion decisions; subscription decisions; and authors’ intention to submit manuscripts. Recent literature from both the Communication and Hospitality Management disciplines suggests that there are wide differences in the formulas used by editors to calculate acceptance rates. Because differing methods of acceptance rate calculation potentially impact significant decisions, a universally accepted and applied standard could be developed. A normative standard, grounded in a specific (...) core ethical principle, is generally preferable to a nonfoundational approach. Two primary approaches to the study of ethics have prevailed through time, teleological ethics with a focus on consequences as represented by Mill’s Utilitarian ideals and deontological ethics with a focus on duty as represented by Kant’s Categorical Imperative. This analysis applies these two ethical frameworks, utility and duty, to the journal editors’ dilemma of finding a common, normative method to calculate acceptance rates. (shrink)

Is it possible to fight a limited nuclear war? Is North Korea as strong as the United States? Such questions have (...) been around since the 1950s. Kirshner does not help us to answer them. Within the context of questions raised by gender and sexuality studies about the relationship between sex and technics, I develop a theory of sexuation derived from Gilbert Simondon’s philosophy of individuation. First, I provide an overview of Simondon’s philosophy of individuation, from the physical to the collective. In the second section, I turn to the question of sexuality, outlining an ontogenetic account in which sexuation is conceived as a process of both individuation and relation that is fundamental to certain living (...) beings. Then, drawing on Simondon’s theorization of technics in its mediating function between humans and the world, I resituate understandings of the relation between sex and technics. While each section – Individuation, Sexuation, Technicity – argues for the significance of these concepts to feminist and queer theory, overall the essay uses Simondon’s work as a new paradigm for gender and sexuality studies and calls for the invention of a sexuate culture. American universities are increasingly proactive in dealing with conflict of interest problems of their faculty. Changing social norms, publicized scandals, and more have made both university administrators and faculty extra alert to the dangers of faculty infidelity to their roles as teachers and scholars. Personal interests — both financial and non-financial — appear increasingly to pressure faculty to behave inappropriately. Most faculty members resist those pressures. Yet, enough conduct that either is, or appears to be, improper has occurred to prompt (...) the adoption by universities of an ever-more complex regulatory regime. This regime no longer relies primarily upon threats of after-the-fact punishment for gross deviations from professorial norms. Instead, universities have also enacted a wide array of in-advance restrictions. These include required disclosures by faculty members of certain private interests, prohibitions of specific faculty behavior, and specified instances in which faculty members must temporarily withdraw from their professorial roles in light of their private interests. This article draws especially upon the author’s experience at the University of California to illustrate the new system of regulation. (shrink)

The patient safety movement seeks to reduce the number of avoidable injuries and diseases that patients suffer while in hospital. Two regulatory strategies in support of that movement are explored here. “Required disclosure” would rely on market responses to an increase in publicly available information about hospital errors. “Performancebased regulation” would require hospitals to reduce their error rate or suffer substantial financial penalties. Both approaches are designed to give medical service providers incentives to promote safety without resorting to “command and (...) control” regulation under which government experts tell hospitals how to act. Cloth, $168.00. When James Force and Richard Popkin published their Essays on the Context, Nature, and (...) Influence of Isaac Newton's Theology in 1990, they launched a new sub-genre in Newton studies. Their seminal work opened up new scholarly vistas in the study of Newton's antitrinitarian theology, his millenarian prophetic hermeneutics, the relations between his theology and his natural philosophy, and the historical legacies of these until recently under-researched aspects of his thought. Force and Popkin have excelled particularly in leading the attack on the two variants of the "two-Newton" thesis: first, that Newton's theological and alchemical works were the result of a putative post-middle-aged madness or the meandering mind of an old man and, second, that Newton somehow disassociated his "pure" science from the problematic contaminations of alchemy and theology. This new volume of thirteen essays is the latest product of this effort to restore unity to Newton's life and thought.The first paper, by Deborah Harkness, outlines the work of the Elizabethan magus John Dee for the purpose of suggesting possible analogies with Newton. In the second essay, Allison Coudert seeks to update the Yates thesis: the proposal that modern science received an early and powerful stimulus from occult philosophy. Unlike Yates, who focused on Hermeticism, Coudert sees the main occult impetus to the rise of science in a renewed Gnosticism that emphasized the need to recover the original prisca sapientia (ancient wisdom). Coudert locates Newton in this latter tradition. In the third paper, James Bono sets out to revise and extend William Ashworth's 1990 study of the impact on the history of science of the "emblematic" world view. Bono seeks to show that Newton retained a commitment to the unity of the Books of Nature and Scripture, even while rejecting what he saw as the corruption and idolatry of man-made systems of symbols in favor of a program of discovering God's hand at work in creation.In the fourth and fifth papers, Justin Champion and Rob Iliffe detail aspects of Newton's engagement with Catholicism. Champion skillfully demonstrates how and why Newton appropriated what he saw as acceptable elements of the incipient textual criticism of the Catholic priest Richard Simon. Notwithstanding his use of this product of Catholic scholarship, Newton's virulent anti-Catholicism is detailed in a sophisticated account by Iliffe, who shows that it extended well beyond Newton's already explicated anti-papist prophetic exegesis.The sixth, seventh, and ninth essays examine Newton's study of history. In the sixth paper, Robert Markley shows how Newton deployed universal history in his quest to trace the origin and subsequent corruption of pure religion. Continuing the theme of religious apostasy, in the seventh essay Matt Goldish examines Newton's ecclesiastical history "Of the Church." Goldish describes how Newton's painstaking research uncovered the corruption of primitive religion by paganism, gnosticism, kabbalism, emanationist doctrines, and other such human interventions. The ninth paper by Kenneth Knoespel contains a study of Newton's ponderous and often impenetrable manuscript Theologiae gentilis origins philosophicae. But like Nicodemus, the secret disciple of Jesus, he never made a public declaration of his private (...) faith – which the orthodox would have deemed extremely radical. He hid his faith so well that scholars are still unravelling his personal beliefs. His one-time follower William Whiston attributed his policy of silence to simple, human fear and there must be some truth in this. Every day as a public figure and as the figurehead of British natural philosophy, Newton must have felt the tension of outwardly conforming to the Anglican Church, while inwardly denying much of its faith and practice. He was restricted by heresy laws, religious tests and the formidable opposition of public opinion. Heretics were seen as religiously subversive, socially dangerous and even morally debased. Moreover, the positions he enjoyed were dependent on public manifestations of religious and social orderliness. Sir Isaac had a lot to lose. Yet he knew the scriptural injunctions against hiding one's light under a bushel. Newton the believer was thus faced with the need to develop a modus vivendi whereby he could work within legal and social structures, while fulfilling the command to shine in a dark world. This paper recovers and assesses his strategies for reconciling these conflicting dynamics and, in so doing, will shed light on both the nature of Newton's faith and his agenda for natural philosophy. Two prevailing paradigms explain the diversity of sex-determining modes in reptiles. Many researchers, particularly those who study reptiles, consider genetic and environmental sex-determining mechanisms to be fundamentally different, and that one can be demonstrated experimentally to the exclusion of the other. Other researchers, principally those who take a broader taxonomic perspective, argue that no clear boundaries exist between them. Indeed, we argue that genetic and environmental sex determination in reptiles should be seen as a continuum of states represented by species (...) whose sex is determined primarily by genotype, species where genetic and environmental mechanisms coexist and interact in lesser or greater measure to bring about sex phenotypes, and species where sex is determined primarily by environment. To do otherwise limits the scope of investigations into the transition between the two and reduces opportunities to use studies of reptiles to advance understanding of vertebrate sex determination generally. © 2004 Wiley Periodicals, Inc. This study explored Christians’ view that living a healthy lifestyle by eating right and exercising was essential to what being a Christian meant to them, theoretically representing internalization of these health behaviors into one’s religious values and identity. Using a secondary data analysis of Pew Research Center survey data, we found that a minority of Christians (16%) internalized a healthy lifestyle; who also tended to be more religious, as expressed by believing in God, reading scripture, praying, and volunteering at church. (...) The results provide preliminary support for the theorized disconnect in religious internalization of certain health behaviors, but not others. However, further exploratory analysis suggests that individuals who are a part of denominations that more recognizably express the importance of a healthy lifestyle as a part of their religious beliefs, and internalize this belief, might subsequently participate in and self-report healthier behavior. Everyone knows what it is to feel a conflict between a ‘non-rational’ desire and reason, as e.g., when we want a second dish of ice cream but think it would be unwise to take it. In such cases we commonly think of our desires as unreasonable: they prompt us to perform some action contrary to our deliberations. Nevertheless, most of us assume that reason can move us: that simply recognizing an act as the most reasonable thing to do gives us (...) a motive to do it — even if in fact we do not perform that action. If we do not eat the second dish of ice cream we are disposed to think that we did not because we judged it unwise. If, on the other hand, we do eat the second dish, we are disposed to think we did because we were more strongly inclined toward eating than not eating, even though we were inclined toward refraining because we judged eating unwise. This is the position of the man on the street. It is the commonsensical notion of reason, motivation, and their relationship. (shrink)

The first edition of Isaac Newton's famous Principia mathematica (1687) contains only one reference to the Scriptures and one mention of God and natural theology. Thus, there is superficial evidence to suggest that this pivotal work of physics is a mostly secular book that is not fundamentally associated with theology and natural theology. The fact that the General Scholium – with its overt theological and natural theological themes – was only added to the Principia a quarter-century later with the second (...) edition of 1713 may also suggest that this theology came as an afterthought and is therefore not integral to the conceptual structure of the Principia . Moreover, the relative paucity of theology in the first edition, combined with the evidence of the appended General Scholium of 1713, could be used as evidence of a ‘theological turn’ in Newton's thought after 1687. This article uses evidence from Newton's private manuscripts to argue that there is more theology in all three editions of the Principia than a simple reading of the published text would imply. This article also demonstrates that the seeds of Newton's theological conception of Nature and the cosmos – conceptions that can be found in manuscripts beginning in the early 1690s, and that are acknowledged in the General Scholium of 1713 – are already present in Newton's private papers prior to 1687. Newton engaged in a great deal of theological writing after 1687, but the period of the composition of the Principia only marks the end of the first third of Newton's six-decade intellectual career and thus it should not be surprising to find more theology after the Principia than before. Nevertheless, there are important theological writings going back to the 1660s that show that Newton's strongly biblical and providentialist theology pre-dates the Principia and, crucially, that his theological conception of the cosmos does as well. The first edition of the Principia , therefore, was composed after Newton had begun to formulate his theology and theological understanding of the cosmos. (shrink)

Critics often charge that agent-causal libertarianism is unintelligible due to the uniqueness of agent-causation—the sui generis causal relationship said to be involved when agents make free choices. This paper presents five objections, which are taken to be the only good objections, to agent-causal libertarianism and argues they all fail to show agent-causal libertarianism is unintelligible. The first four objections fail outright. The fifth objection fails in a special way. Naturalistic agent-causal libertarian theories succumb to this fifth objection; theistic agent-causal libertarian (...) theories do not. This entails that if agent-causal libertarianism is intelligible, then it is only so within theism. (shrink)

In light of the rising anti-racist and decolonial struggles breaking out in the world, this essay seeks to displace the theoretical dichotomy between ‘violence’ and ‘non-violence’. We begin by revisiting Arendt and Fanon to argue that within the conditions of colonial-racial capitalism, ‘non-violence’ is merely a theoretical abstraction. Building on Fanon, who understands decolonial struggle as setting the ‘atmospheric violence’ of colonization into motion toward a new humanity, we develop our own vocabulary of revolutionary anti-violence that replaces a static dichotomy (...) with a spectrum of spontaneous insurrectional activity, non-retaliatory anti-violence, self-defense, and offensive armed struggle. From these, we reinterpret various struggles and distinguish them from terrorism. By centralizing anti-violence as an ethical ideal and political struggle, we aim to overcome the unproductive pitting of ‘good’ (non-violent) movements from ‘bad’ (violent or terrorist) ones and offer a political theory of violence more appropriate to our times. An elementary theory T in a language L is (strongly) finitely inseparable if the set of logically valid sentences of L and the set of T-finitely refutable sentences are recursively inseparable. In §1 we establish a sufficient condition for the elementary theory of a class of BA's with operators to be finitely inseparable. This is done using the methods developed independently by M. Rabin and D. Scott (see [6]) on the one hand and by Ershov on the other (see [2]).

The focus of this Perspective article is on the comparison of two of the most popular initial applicant screening methods: Resumes and application forms. The viewpoint offered is that application forms are superior to resumes during the initial applicant screening stage of selection. This viewpoint is supported in part based on criterion-related validity evidence that favors application forms over resumes. For example, the biographical data inventory, which can contain similar questions to those used in application forms, is one of the (...) most valid predictors of job performance, whereas job experience and years of education, which are often inferred from resumes and cover letters, are two of the least valid predictors of job performance. In addition to validity evidence, making decisions based on application forms as opposed to resumes is likely to help organizations defend against claims of discriminatory hiring while enhancing their ability to hire in a more diverse, equitable, and inclusive manner. For example, applicant names on resumes can lead to screening bias against members of identifiable subgroups, whereas an applicant’s name can be easily and automatically hidden from decision-makers when reviewing application forms. Despite these convincing arguments focused on applicant quality and diversity, a substantial research–practice gap regarding the use of resumes and cover letters remains. (shrink)

The overriding theme of the conference honoring Bob Cooter and his work is the question whether law and policy can change people’s preferences. The conventional “law and economics” answer is “no.” People have preferences that are fixed. What changes in law and policy do is to change how people behave by altering the costs and benefits people face in pursuit of their preferences. Put simply, the assumption of the “law and economics” model is that people respond to financial incentives by (...) changing how they act, not what they want. So, to take a simple example, imagine two people at the same starting point, both wanting to drive separately to visit a mutual friend. Their preference to get there promptly and safely is common to both of them, but how they act in pursuit of that goal may well differ. Moreover, government can alter how they drive to their friend’s by making changes such as putting in a freeway, or adding a new lane to the road, or installing lots of new traffic signals or stop signs along one route. The two people may have driven different routes previously, and they may alter their driving strategy in response to the policy changes government has adopted and may still decide that different routes are better for them. But they do not change their desire to see their friend in a prompt and safe manner. In this Article I offer a counterexample — an instance in which changes in law and policy can not only alter the behavior of some with fixed preferences, but also can impact the preferences of others. My example is about changes in society that can alter parenting style (of those parents with a fixed preference to have their children succeed) and can also change the underlying preferences that those children have as to how their lives should play out.
